Legal Document Assistant Services

 LEGAL DOCUMENT ASSISTANT DISCLOSURE, SERVICE AGREEMENT, AND CLIENT ACKNOWLEDGMENT

My Mobile Notary Public & Document Services, LLC provides services as a Registered California Legal Document Assistant ("LDA"), California Notary Public, and document recording/courier service provider. By engaging in our services, you acknowledge and agree to the following:

1. Legal Document Assistant Disclosure

My Mobile Notary Public & Document Services, LLC is a registered California Legal Document Assistant. We are not attorneys and cannot provide legal advice, legal opinions, legal representation, or recommendations regarding your legal rights, remedies, defenses, options, or strategies. No attorney-client relationship is created by our services.

You acknowledge that you have independently selected the document(s) you wish to have prepared and have not relied upon My Mobile Notary Public & Document Services, LLC to determine whether any document is appropriate for your specific situation. If you have questions regarding your legal rights, ownership interests, title matters, estate planning, tax consequences, liability, or the legal effect of any document, you should consult a licensed attorney or other qualified professional before proceeding.

2. Scope of Services

Our services may include legal document preparation services as a registered California Legal Document Assistant, notarial services performed as a California Notary Public, and document recording or courier services. Each service is separate and independent.

When acting as a Legal Document Assistant: we provide self-help document preparation services based solely on information and instructions provided by the client.

When acting as a Notary Public: Our duties are limited to those authorized by California law and do not include providing legal advice, selecting documents for clients, determining whether a document is appropriate, or advising clients regarding the contents or legal effect of a document.

Recording and courier services are ministerial services only and do not constitute legal, escrow, title, settlement, or real estate brokerage services.

3. Information Provided by Client

All documents are prepared solely from information and instructions provided by you through questionnaires, emails, telephone conversations, meetings, written instructions, or supporting documentation. You are solely responsible for the accuracy, completeness, and legal sufficiency of all information provided.

You agree to carefully review all completed documents before signing and are responsible for verifying that all names, dates, legal descriptions, vesting information, property information, beneficiary designations, and other document contents are accurate and reflect your intentions.

4. Notary Services Disclaimer

Notarial services are limited to verifying identity, witnessing signatures, administering oaths or affirmations, and completing authorized notarial acts as permitted by California law. A notarization does not validate, verify, approve, or guarantee the accuracy, legality, effectiveness, enforceability, or truthfulness of any document or its contents.

5. Recording Services Disclaimer

If requested, My Mobile Notary Public & Document Services, LLC, may submit documents for recording or filing as a convenience to the client. We do not guarantee that any document will be accepted for recording or filing, nor do we guarantee the legal effect, validity, priority, enforceability, or marketability of title resulting from any recorded document.

Recording requirements, filing requirements, processing times, acceptance, rejection, and fees are determined solely by the applicable government agency, court, recorder's office, or filing authority and are beyond our control.

6. No Legal, Tax, Escrow, or Title Advice

My Mobile Notary Public & Document Services, LLC, does not provide legal advice, tax advice, accounting advice, title opinions, title examinations, title insurance, escrow services, settlement services, investment advice, or real estate brokerage services.

We do not determine ownership rights, advise on vesting choices, evaluate legal consequences, predict tax implications, guarantee protection from reassessment, or provide opinions regarding the legal effectiveness of any document. Clients are encouraged to seek advice from qualified professionals regarding these matters.

7. Fees and Refund Policy

Fees charged are for services performed and time incurred. Fees earned for services already performed are non-refundable. Once document preparation work has begun, refunds may be limited to amounts not yet earned or incurred.

Government filing fees, recording fees, notary fees, courier fees, shipping charges, and other third-party costs are separate from service fees and are non-refundable once incurred.

8. No Guarantee of Outcome

No guarantee is made regarding the legal effectiveness of any document, recording acceptance, filing acceptance, court approval, title status, tax consequences, creditor protection, estate planning objectives, or any other legal or financial outcome.

9. Limitation of Liability

To the fullest extent permitted by law, My Mobile Notary Public & Document Services, LLC, its owners, employees, contractors, and agents shall not be liable for any loss, damage, claim, tax liability, reassessment, title issue, recording rejection, filing rejection, court action, delay, or other consequence arising from information supplied by the client, the client's use of the prepared documents, or the legal effect of any document.

Any liability arising from services provided shall be limited to the amount paid by the client for the specific service, giving rise to the claim.

10. Indemnification

Client agrees to indemnify, defend, and hold harmless My Mobile Notary Public & Document Services, LLC, its owners, employees, contractors, and agents from any claims, losses, liabilities, damages, costs, or expenses, including reasonable attorney's fees, arising from information provided by the client, the client's use of prepared documents, or actions taken at the client's direction.

11. Governing Law and Venue

This Agreement shall be governed by and construed in accordance with the laws of the State of California. Any dispute arising out of or relating to services provided by My Mobile Notary Public & Document Services, LLC shall be brought exclusively in a court of competent jurisdiction located in San Bernardino County, California. The parties’ consent to the jurisdiction and venue of such courts.

12. Acknowledgment

By continuing with our services, you acknowledge that you have read and understand this Disclosure and Agreement, that you have had the opportunity to seek independent legal advice, that you have independently selected the document(s) requested, and that you voluntarily request services from My Mobile Notary Public & Document Services, LLC.
